| Abstract | Resumen El Sistema Nacional Ambiental estructurado a partir de la Ley 99 de 1993 ha dispuesto de la existencia de diversas autoridades encargadas de velar por el ambiente y los recursos naturales, entre las cuales sobresalen las Corporaciones Autonomas Regionales y los grandes centros urbanos. Perdiendo de vista la necesidad de que el sistema fuese totalmente coherente, la propia Ley 99 asigno identicas competencias a las mencionadas autoridades, lo que se agrava por el hecho de que, en algunos casos, tales autoridades coinciden en lo que a su jurisdiccion trata. El caso de Barranquilla es una prueba de ello porque coinciden como autoridades ambientales en el mismo distrito tanto la Corporacion Autonoma Regional del Atlantico (CRA) como el Departamento Administrativo del Medio Ambiente (DAMAB). Esta particular situacion que genera desconcierto ante la existencia de competencias repetidas a favor de ambos entes conduce a la busqueda de una solucion, atendiendo a los postulados de la misma Ley 99. Abstract The National Environmental System, structured from Law 99 of 1993, has disposed of the existence of various authorities responsible for the environment and natural resources, among which stand Corporation Regional Auton- omy and large urban centers, losing the most important which is the needing that the system be fully consistent, in fact, the Law 99 assigned identical powers to those authorities, which is compounded by the fact that, in some cases, these authorities agree on what is within their jurisdiction. Barranquilla's case is proof of that, because they match as environmental authorities in the same district, both of them, it means, Corporation Regional Autonomy of the Atlan- tic, CRA, and the Department Administrative Technical of the Environment, DAMAB. This particular situation which creates confusion to the existence of repeated competitions for both entities, leads to finding a solution, following the tenets pertaining to such Law 99. |
