| Abstract | "El estudio de la tesis se centra en la institucion de la revocacion del mandato presidencial, ofreciendo en primer lugar aspectos teoricos sobre esta institucion vista como un instrumento de democracia participativa asi como por la cualidad de ser un instrumento de control de los gobernantes. Se ofrece una introduccion conceptual e historica de la revocacion del mandato para dar paso a un estudio de derecho comparado centrandose en la aplicacion de la institucion para el supuesto de la revocacion del maximo dirigente de un pais. Los cambios de concepcion democratica realizados en las ideologias del llamado ""nuevo constitucionalista latinoamericano"", han permitido que la revocacion del mandato se aplique en algunos paises a todos los niveles de los representantes politicos, incluido el Presidente de la Republica, teniendo como ejemplos Ecuador, Venezuela y Bolivia. Sin embargo solo en estos dos ultimos paises se han realizado procesos de revocacion del mandato presidencial, centrandose la tesis en el estudio pormenorizado de la regulacion que se efectuo para tal fin, asi como de los acontecimientos y problemas a los que el proceso de revocacion del mandato presidencial se vio sometido, y la forma en que se gestiono. Estos analisis nos permiten ofrecer un panorama practico para comprende la necesidad o no de dicha institucion y de las contradicciones que puede encerrar su regulacion y practica, que incluso podra ser de interes para los nuevos procesos de revocacion del mandato presidencial que actualmente se estan gestando en Venezuela. The study of the thesis focuses on the institution of the revocation of the presidential mandate, offering first theoretical aspects of this institution seen as an instrument of participatory democracy as well as the quality of being an instrument of control of the rulers. a conceptual and historical introduction of the revocation of the mandate offers to make way for a comparative law study focusing on the implementation of the institution in the event of the revocation of the leader of a country. Changes democratic conception made in the ideologies of the ""new Latin American constitutionalist"" have allowed the revocation of the mandate is applied in some countries at all levels of political representatives, including the President of the Republic, taking as examples Ecuador, Venezuela and Bolivia. However, only in the latter two countries have carried out procedures to revoke the presidential mandate, focusing the thesis in the detailed study of the regulation that was made for this purpose, as well as events and issues that the process of revocation presidential term was subjected, and the way it was handled. This analysis allows us to offer a practical overview to understand whether or not that institution and contradictions which may enclose their regulation and practice, which may even be of interest to new processes revocation of the presidential mandate that are currently gestating in Venezuela. " |
