| Abstract | The present study contains information on the patent system in the field of Biotechnology from Brazil. In addition, an analysis of patents deposited from 2001 until 2004 in the country under the subclass C12N, which refers to “Microorganisms or enzymes; its compositions; propagation, preservation or maintenance of microorganisms or tissues; genetic engineering or mutations and culture medium” has been performed. The data obtained from the patent database of the National Institute of Industrial Property shows a small fraction of the national depositors less than 5% of the total amount of deposits -when compared to the other countries. In contrast, the United States of America presented more than 33% of all deposits within the C12N subclass in Brazil at the same period. Among the national depositors, 77% of the deposits had been made by public educational or research institutions and none registered by private educational or research institution was found, suggesting that the research and innovation in the field of biotechnology in Brazil are concentrated at the public universities. Regarding the Programa de Pos-graduacao em Biotecnologia da Universidade Federal de Santa Catarina (PPGBiotec), the collected data demonstrates a similar profile to that found in Brazil. Moreover, it was noticed that researchers do not use patent documents as information source in their research. Four percent of the students and 30.7% of the docents of PPGBiotec have interaction with enterprises in their research projects. Taken together, these results suggest an urgent need for qualifying professionals in the biotechnology field able to generate technological innovation and recognize the tools to protect the generated knowledge. |
