| Description | This chapter covers certain issues in relation to statutory adjudication in the United Kingdom, pursuant to the Housing Grants, Construction and Regeneration Act 1996 (the 'Act'), as amended. It provides an overview of the statutory adjudication regime in the United Kingdom and some recent developments. Those developments relate to the meaning of construction contract, contracts that are excluded by the Act, the interplay between adjudication and insolvency, the crystallization of a dispute, smash and grab adjudication, reserving a party's position on jurisdiction, stay of execution and invalidity of an adjudication due to fraud. It summarizes the rules and some case law concerning low value adjudication schemes, published by the Technology and Construction Solicitors Association and the Construction Industry Council. Finally, it summarizes the results of a review of the changes brought about by the Local Democracy, Economic Development and Construction Act 2009, produced by the Department for Business, Energy & Industrial Strategy, which suggest certain changes that ought to be brought about to the existing Act and Scheme.
