| Description | Due to the complexity of large international construction projects, disputes often arise during the project implementation. Because of the broad range of participants in large construction projects, the local litigation is usually not favorable to the international participants, therefore alternative dispute resolutions are often used. This chapter introduces the well-known alternative dispute resolution mechanisms used in large international construction projects, e.g., mediation, adjudication, dispute board, and arbitration. It then explains the procedure and relevant approaches set out in the leading standard forms of contract, including FIDIC, NEC, and JCT. Finally, it concludes with recommendations for drafting dispute resolution clauses during the contract negotiation stage as well as the pitfalls and best practice during the post-contract implementation stage.
