The following Judgment of the Conrt was delivered by KAPUR J.-This is an appeal by specialleave brought by J. K. Chaudhuri for and on behalf of the GoverningBody of Guru Charan College, Silchar (whichwill be referred to in thisjudgment afl the College) against a judgment and order of the High Court of Judicature in Assamdated June 13, 1956, dismissing the appellant'spetition under Art. 226. It raised the questionas to the nature and extent of the jurisdiction of the Executive Council of the University of Gauhati in regard to disciplinaryaction taken by the Governing Body of the College against its Princi. pal,R. K. Datta Gupta,respondentNo. 1. In 1937, respondentNo. 1 wasappointedProfessor of Mathematicsin the college. He was appointed Vice-Principalin 1947and Principalin 1950.Due to certainrepresentationsmade to theGoverningBody againstrespondentNo. 1, a committeewas appointed by the GoverningBody to enquireinto the allegations. Thiscommitteeheld severalsittings and made a report after consideringwhich the GoverningBody helda primafacie case made out against him,placed himundersuspension and calledupon him to answer the chargeswithin 15 days. This he failed to do but later on submitted an explanationwhich was duly considered.As freshmaterialwas disclosed after the suspension,respondent No. 1 wascalledupon to give a further explanation.
