Headnote | Medical Council of India Act, 1956 - s.10A - Establishment of new medical college for the academic year2015-2016 -Application uls. 10A- Rejected on the groundthat Essentiality Certificate and Certificate of Affiliation notsubmitted before the cut-off date - Petitioner had submittedthe application but the essentiality certificate was issued late and was subsequently submitted- Writ petition there againstallowed with the direction to the Medical Council to considerthe application of the petitioner- However, Division Bench.set aside the order - SLP before this Court - Applicationdisposed of with a direction to the Medical Council of India to consider the application and make its recommendation withinthe stipulated period - Submission of inspection report in asealed cover by Medical Council - Challenge to - Held:Executive committee of the council noted many deficienciesin the report and returned the application for establishmentof a new Medical College to the Central Governmentrecommending disapproval of the scheme uls. 10A for theacademic year 2015-2016 and 2016-2017 - In the facts andcircumstances of the case, no directions can be issued to the respondent to consider the case of the petitioner, since .the matter is yet to be decided by the Central Government-However, no opinion is expressed with regard to therecommendation made by the Council to the Central·Government disapproving the scheme for the academic year2016-2017 also - Petitioner to move the appropriate forumas against the decision of disapproval for the academic year2016-2017 - Establishment of Medical College Regulation(Amendment), 2010- cl 8(3)(1)(d). |

It is sponsored and mentored by Ministry of Education, Government of India, through its National Mission on Education through Information and Communication Technology (NMEICT). It is designed to enable people to learn and prepare from best practices from all over the world and to facilitate researchers to perform inter-linked exploration from multiple sources. It is developed, operated and maintained from Indian Institute of Technology Kharagpur.
