Headnote | Penal Code, 1860 - ss. 366, 376(g) & 120-8 - A/legationthat prosecurtix was forcefully taken away, and subjected torape by the appellant and his three accomplices - Convictionof appellant - Justification - Held: Justified, in view of thestatement of the prosecutrix uls. 164 CrPC, as a/so, thestatement made by her before the trial court, and the mannerin which she was subjected to cross-examination -Substantial material corroborating the statement of theprosecutrix for unequivocal determination of the guilt of theappellant - Prosecutrix was recovered from the custody ofappellant and thereafter, subjected to medico-legalexamination by PW1 - PW1, in her independent testimony,affirmed that she had been subjected to sexual intercourse,inasmuch as her hymen was found ruptured - Deposition ofprosecutrix scientifically substantiated by report of FSL andof the Serologist - Defence plea that prosecutrix hadaccompanied the appellant, and had sexual intercourse withhim consensually completely ruled out, because as per thesubstantiated prosecution version, prosecutrix was not takenaway by the appellant alone, but also, by his threeaccomplices - All four of them had similarly violated herperson - PWB, the father of the prosecutrix, a/so in materialparticulars corroborated the testimony of the prosecutrix -Further, the prosecutrix was a minor on the date of occurrence- Even if she had accompanied the appellant of her own freewill, and had had consensual sex with him, the same wouldhave been clearly inconsequential, as she was a minor. |

It is designed to enable people to learn and prepare from best practices from all over the world and to facilitate researchers to perform inter-linked exploration from multiple sources. It is developed, operated and maintained from Indian Institute of Technology Kharagpur.
