Abstract	The current document generates a reflexive analysis regarding the procedural guarantees that support the dismissal of sheltered workers by a special constitutional protection jurisdiction, as it is the case of women in pregnancy or breastfeeding in the light of established case law. for that matter in the precise, it is intended to determine if the guarantee may be excessive in its use, or deserves more precision, since there may be an excessive use of this constitutional protection, based on a procedural regulation that places many guarantees in the employee, and few in the employer.
