Abstract	Legal doctrine and case law doctrine about the difference between fraud and conscious guilt are not undisputed. In some situations, like traffic accidents, the difference is difficult to establish. This paper will focus on the analysis of this theme and try to give an answer from the contemporary criminal theory and, thus, study if there is a solution to this current problem and examine if these conducts are intentional or negligent types.
