| Abstract | The Spanish Government has requested of the Council of State his opinion about the reform of four key questions of the constitutional text: one of them is the modification of the juridical base that allows to Spain to take part in the process of European integration. Precisely, this commentary turns on the interpretation and application that has been realized of the juridical current base up to the date. Departing from the current regulation, the present work examines the arguments and the offers adopted as the Council of State to modify the above mentioned juridical base, in order to adapt it and to update it to the predictable evolution of the process of European construction. Nevertheless, an arrested analysis of his opinions and intentions they allow us to affirm that only they manage to introduce superficial modifications that allow us to question its opportunity. |
