Abstract	The article presents the analysis of the new role acquired by victims within the adversarial system, which have the power to be heard and present evidence in resolving cases in which their rights have been affected. This by the transformations undergone by the Colombian legal system, in which a restatement of the status of the actors involved in it originates; to establish guidelines with which the State can fully meet its responsibility to protect the guarantees and in turn, the audit for compliance with the duties that lead to the full observance of the law, contributing to the consolidation of rule of law. In its realization then it was on a question problem in which states how to describe the scope of the rights of victims to be heard and present evidence under the accusatory penal system ?, using for this purpose the query from different sources and guidelines derived from the methodology of legal research and analysis of jurisprudential text.
