Abstract	The purpose of this investigation radico in: Analyzing the Right to Retirement to the proposed legislation of a General and Uniform System under the Venezuelan Social Security System. The method of research was documentary, was approached from a qualitative approach and was founded in a deductive and logical schema. Through the collection of information, text, and print media laws related topic investigated were analyzed. The investigation concluded that: ( 1) There is broad protectionist nature of the State to guarantee to all citizens regardless of their ability to contribute to enjoy an economic benefit through pension or retirement age to meet your needs . ( 2) Retirement is a right of employees of government that must be secured gradually and may be affected by the new benefits system . ( 3) the draft of the Law on Pension and Benefit System Allocations other with respect to the procedural requirements of pensions and retirement , discrepancies are evident with regard to the procedural requirements of pensions and retirement . (4 ) Delay by the Executive in the enactment of the Pension Benefit System and other Allocations which creates an expectation on the new pension scheme and retirement . Recommended: Al legislative power to enact laws pursuant to the Organic Law of the Social Security System, which determine the patterns in retirement under the new Venezuelan social security system.
