| Abstract | This research shows the problem of inclusion of family violence as a legal course in the crime of femicide. This type of violence, as his name refers, is developed within a context of familiarity between the aggressor and the victim, being is last in the majority of cases, women who were assaulted by men who have or had a sentimental bond. On the other hand, femicide is a term that emerged after several studies of current feminist, to see the contempt and discrimination suffered by women by the State and society; reaching the point of abusing them and kill them. It is now a global reality that takes place in all walks of life and levels of a society. In reference to this in the Peru statistics show that the large number of cases of femicide have as background the family violence. This research will determine the subjective, socio-economic and cultural factors that led the State to regard family violence as legal case of the crime of femicide regulated in the Peruvian Penal Code (Art.108-B). Using for this purpose techniques and data collection instruments, specifically the technique of documentary collection. It will also identify the figure of family violence from the law No. 26260, law No 30068, law No 30364 and the Decree legislative number 1323; and in contrast to comparative law, using the technique of interpretation rules. In this way, it can be concluded that despite the factors causing family violence is determined, which is regulated by itself and within the crime of femicide with very severe penalties the problem, has not had the expected results due to the lack of preparation and constant training of police and legal researchers. |
