| Abstract | Constitutional Court of Venezuela declared unenforceable a judgment of the American Court of Human Rights, thereby causing the failure to a document issued by an international organization that prevail the Constitution, as it has rights of better quality than those provided for in the Constitutional Charter, also it is mandatory for those who ratified the American Convention on Human Rights, an erroneous interpretation of that Court victims hurt when exercising its rights under that document, this created a shortcoming of the Inter American Human Rights System. The analysis of this fact is needed because this has created a legal precedent for transcendence in member countries, and to try to prevent a similar event should take corrective in the mechanisms used by the Inter-American Court of Human Rights in relation to its power of monitor compliance with judgments and other decisions of the Court. |
