| Abstract | The German Civil Law influences the Brazilian Civil Law since colonial times. The German Civil Code 1900 (BGB) is the core of this influence. The provisions of the BGB and the theories developed by German lawyers are the basis of various institutes of civil law in Brazil. The BGB is much criticized by German professors for their alleged liberal character and his anti-social nature. These criticism appeared in the process of civil codification and resumed in the long night of Nazism. The criticism against the BGB was reproduced in relation to Civil Code of 1916. It is necessary to revise many consensuses about the BGB. The concepts of liberalism and conservatism are the basis for many of the misconceptions about the German civil codification. In Germany, there are new authors and new intellectual references in Civil Law, which need to be studied in Brazil. |
