| Abstract | The present work has the main objective of tackling the right to prior enquiry, an inherent collective right of indigenous communities that inhabit our continent, mainly in Latin America, and to determine the reason for it ́s recognition, it ́s concept and opportunity for application, minimum requirements for it ́s configuration and connection with other collective rights. Also, this essay attempts to provide a review of the most relevant legal instruments enshrined in domestic law and International and Inter-American Human Rights System that recognize prior consultation, as well as some pronouncements by the Inter-American Court of Human Rights which impose unavoidable obligations on States that must observed when the socio-economic and cultural rights of indigenous peoples living in their territories are affected, to not incur serious international responsibility. Finally, this essay culminates with the formulation of a conclusion arisen from the analysis, which only aspires to lead a reflection. |
