| Abstract | This dissertation work has as its main objective to identify that the incorporation process of women in the Ecuadorian Air Force, branch of the Armed Forces of Ecuador has distorted the no discrimination guarantee as well as access to equal opportunities for female gender, found in article 11 of the Ecuadorian Constitution. Within a historically patriarchal institution such as the Ecuadorian Air Force, the phenomenon of incorporating women in the Military Force has lead to a great violation of rights, even nowadays when there is no guarantee of access and tenure for women in the Military career. In 2009, in order to optimize the process of female incorporation into the Armed Forces of Ecuador, the “Reglamento Transitorio para garantizar la aplicacion directa e inmediata de los derechos del personal femenino de Fuerzas Armadas” (Temporary regulation to guarantee the direct and immediate application of the rights of female staff in the Armed Forces) was created. Given that it is a relatively new phenomenon and still under construction, it has not been possible to analyze from the point of view of the differences found among equal opportunities, as well as the situations found in the internal regime, such as passes, maternity and breastfeeding, infrastructure, among others. The legal norms that govern the coexistence of uniformed personnel in a mixed institution such as in the Ecuadorian Air Force, it is insufficient given that the female staff must abide to laws specifically created for male staff; this has lead to the violation of several rights constitutionally consecrated. In order to repair the existing loopholes and inconsistencies present in the existing legal norms, the proposal of this dissertation is the reform of “Reglamento Transitorio para garantizar la aplicacion directa e inmediata de los derechos del personal femenino de Fuerzas Armadas”. (Temporary regulation to guarantee the direct and immediate application of the rights of female staff in the Armed Forces) this reform will provide the active participation of females in the military career, based on respect of their rights, protection of the family circle and equal opportunities. |
