| Abstract | Based on the analysis of some challenges presented by the adversarial criminal process, this paper addresses the following issues: the individualization of sanctions, reparation of damage and its guidelines to fix them, the role of the judge in the hearing to individualize sanctions and repair the damage, and the appeal against the decisions of the judge of first instance. The author argues that the figure of the Popular Jury in Mexico, valid from 1869 to 1930, should be studied in order to understand the development of oral trials in this country.
