Abstract	This article analyzes the Institute of General Effect on extraordinary appeal and its compatibility with the fundamental right of access to justice. For this, initially examines the principle of access to justice and then analyzes its compatibility with the novel Institute of general repercussion in the extraordinary appeal. It concludes that it is fully compatible coexistence of said fundamental right with the new institute, because of the right of access to justice does not guarantee access to the Supreme Court, and because of the relative character of fundamental law.
