| Abstract | En este trabajo se analiza la intervencion de la Union Europea en el ambito personal y familiar, comparando dicha intervencion con la que tiene lugar en los tratados internacionales mas relevantes (Declaracion Universal de Derechos del Hombre, Pacto Internacional de Derechos Economicos, Sociales y Culturales y Convencion de Derechos del Nino) y en la Constitucion Espanola. Las conclusiones que se obtienen son varias. Por una parte, no se advierten grandes innovaciones ni en los Tratados de la Union Europea ni en la Carta de los Derechos Fundamentales de la Union Europea, que se limita a reiterar derechos proclamados en instrumentos internacionales y constituciones como la espanola, si bien con la Carta pueden considerarse definitivamente liquidadas las relaciones matrimoniales y familiares basadas en la jerarquia. Por otra parte, el mayor grado de intervencion de la Union Europea en la familia tiene lugar a traves del Derecho derivado que, con base a sus competencias en el mercado interior, ha configurado un modelo especifico de familia transfronteriza. Este trabajo es un alegato juridico en pro de la libertad de la configuracion de las relaciones personales y familiares que en la actualidad impiden las normas nacionales, europeas e internacionales. This paper analyzes the European Union intervention in the area personal and family, comparing the intervention with those that take place in the most relevant international treaties (The Universal Declaration of Human Rights, The International Covenant on Economic, Social and Cultural and The Convention on the Rights of the Child) and in the Spanish Constitution. The conclusions obtained are several. First, no major innovations are noted in the European Union Treaties nor in the Charter of Fundamental Rights of the European Union, which merely reiterates rights enshrined in international instruments such as the Spanish Constitution, although the Charter be considered definitive liquidation of the marriage and family relationship based on hierarchy. Moreover the highest level of European Union intervention in the family takes place through legislation which, based on their expertise in the internal market has set up a specific model of cross-border family. This work is a legal argument for freedom of setting personal and family relationships that currently are impeded by national, European and international legal rules. |
