| Abstract | The old lack of laws guaranteeing rights to the affected people by hydroelectric Projects is precisely the new situation that this population is currently living in 2015. In order to ascertain to what extent those affected by dams has advanced legally in their achievements for citizenship guarantee , and also understand how legal tools can serve or not to political, economic and social interests, I do an analysis of Decree No. 7342/2010 and the Ministerial Decree No. 340/2012, which are the latest regulations that guide the registration of this population. The presented work is justified by the importance of the debate about the social impacts caused by dams, especially in Brazil. It is possible to assume that the lack of commitment from the competent sectors, public and private, to effectively solve the problems of the affected people by dams is at least convenient for both, allowing the interested parties to "negotiate" the "damages" case by case, as acting, or not, the social movements. The lack of rules that uniformizem the treatment of social issues related to hydroelectric projects, only increases the impacts caused by them, which offers a plausible justification for proceeding in the subject of studies of this bias. |
