| Abstract | This research shows the reasons which cause the application of the judge s inhibition for lack of competence and their influence in the procedures of the Fifth Civil and Mercantile Court of Riobamba city. To carry out this research different doctrines from the bibliography related with this subject will be exposed. It has been necessary the bibliographical support from different legal corps related to the problem of the research. The surveys are the most important contribution applied to lawyers who know the reasons to avoid the bad application of the judge s inhibition for lack of competence. This research is divided into: chapters, units, themes and sub-themes. Chapter I is composed of: Referential Mark conformed by problem formulation; objectives such us general and specific, which evidence importance of this lack. Chapter II Theoretical Framework, the research of the subject has been developed which have three unites which are the following: background, theoretical foundation, classification, resources, concepts, its applications; where we have wide analysis to be able to know and see the difference of the inhibition for the lack of competence. Chapter III is composed by: Methodological frame and its components; procedure, discussion of results and the primordial the hypothesis testing. In chapter IV Conclusions and recommendations of this research are exposed where there is the basis of the investigation.
