| Abstract | This article proposes an impact analysis for declaratory classification of pragmatic principles’ constitutional requirements, through the viewpoint of illustrious jurist Jose Afonso da Silva’s tripartite theory, in the current panorama of symbolic constitutionalization. The traditionalism and dogmatism that surround the topic are based in authority discourses, which empty the scientificity of fundamental rights theory and provide alibis that make inviable the social realization of constitutional norms which occurs in evident dissonance to a proposed true democratic rule of law. |
