| Abstract | The main purpose of this study is to demonstrate that indigenous peoples, as peoples, have the right to self determinate themselves in their territories. The indigenous territory is the space where they exercise their self determination right; consequently, the indigenous territorial rights are more protective than the traditional concept of civil property and include autonomy and sovereignty over their natural resources, even the non-renewable ones. The respect of the indigenous territory and their sovereignty over their natural resources prevail, in the frame of International Human Rights Law, to any act, economic interest or political rule inside the State. |
