Abstract	espanolLa sentencia C-415/11 del TJUE ejemplifica y coloca en destaque el problema habitacional espanol, estableciendo la ilegalidad de la normativa espanola en materia de desahucios, la cual vulnera la legislacion europea en materia de consumidores. Mas de 600.000 desahucios hipotecarios se han producido en Espana en el periodo 2008-2015 (primer trimestre), destacandolo como el pais que mas lanzamientos efectua en el continente europeo. Al mismo tiempo, varios problemas actuan con efecto limitador al derecho a la vivienda digna protegida en la Constitucion Espanola (Art 47). La falta de la vivienda social en Espana, que representa unicamente el 1% frente al 32% de Holanda o el 18% de Reino Unido y el amplio numero de viviendas vacias, el 30% del total de Europa son claros sintomas del problemas.
