| Abstract | This essay seeks to examine the extent to which theories developed in recent decades about the criminal phenomenon can become punitive instrument of expansion, in view of the recent wave of criminalization of social movements, particularly given the controversial role of movements such as the Rural Workers Landless (MST). The study notes the thinking of theorists like Claus Roxin in criminal matters and its correlation with widely read authors in the social sciences, such as Beck, and the concepts developed in both sociology and criminal theory about the phenomenon of risk in post-industrial societies, now globalized. Thus, it is possible to establish a significant correlation between two growing trends in post-modernity: the resurgence of the fights promoted by social movements and reactions of punitive apparatus, with criminalization policies adopted by the criminal justice system. |
