| Abstract | espanolPara algunos tratadistas existen ciertos temas que resultan de acceso restringido para la jurisdiccion constitucional: se trata de los derechos sociales. De acuerdo con un sector de la doctrina son derechos vedados para la jurisdiccion constitucional, por considerarlos derechos de imposible o dificil judicializacion que implicaria, para el organo jurisdiccional, rebasar sus naturales fronteras hacia terrenos solo aptos para los poderes politicos. En este articulo, se intenta desmitificar esa idea, al analizar algunas jurisprudencias y tesis aisladas sobre el derecho a la proteccion a la salud que ha seguido la Suprema Corte de Justicia de la Nacion en Mexico que, ademas de conservar funciones de control de la legalidad, ha ampliado el ambito protector del juicio de amparo para tutelar de manera directa derechos humanos establecidos en instrumentos internacionales. La jurisprudencia reciente apunta algunos criterios novedosos, proponiendo de manera expresa, clara y contundente la procedencia del amparo por transgresion de garantias individuales o sociales, asi como por violaciones a los derechos humanos establecidos en los instrumentos internacionales. A traves de la emision de jurisprudencia y tesis aisladas sobre el derecho a la proteccion a la salud, la Corte mexicana se ha ocupado de los llamados problemas de determinacion. Por ello resulta imprescindible la funcion reguladora de los jueces en la adecuacion entre los fines constitucionales y los medios procesales para materializar plenamente el derecho a la proteccion de la salud EnglishFor some treatise writers there are certain themes which are considered of restricted access for the constitutional jurisdiction: they are the Social Rights. According with a sector of the doctrine, they are banned rights for the constitutional jurisdiction, because they are considered rights with an impossible or difficult judicialization and which would imply, for the jurisdictional organ, to surpass its natural borders towards fields pertaining only to political powers. This article attempts s to demystify that idea by analyzing some jurisprudences and isolated theses on the right to protect health that has been followed by the Supreme Court of the Nation in Mexico, which besides keeping control functions of legality, has broadened the protecting scope of the judgment for protection to tutor in a direct manner the human rights established by international instruments. Recent jurisprudence points to some new criteria, proposing in a clear and definite way the precedence of the protection against transgression of individual and social guarantees, as well as for violations to those human rights established by international instruments. Through the emission of jurisprudence and isolated theses on the right to protect health, the Mexican Court has taken care of the so called problems of determination. Therefore the regulatory function of the judges is essential in the fitting between the constitutional ends and the processal ways to fully materialize the right to protect health |
