| Abstract | In 1954, a verdict in the city of Buenos Aires absolves Mrs. Elena Teotina Haedo de Gaitan and the midwife Catalina Fuccia of the crime of abortion under the legal figure of the “attempt of impossible abortion “. In the case, though the abortive maneuvers were verified, the defending attorneys and the judges indicated that it was not possible to prove scientific and medically the pregnancy. In this article, we ask ourselves about the scopes of the Law to punish the abortion in the Argentina of mid 20th century in a context known as as pronatalist by the historiography. From the analysis of the judicial processes on abortion, we wonder about the different forms of tutelage on the body and the reproduction of women. |
