Es el primero que sometio a la justicia a los responsables de la dictadura y uno de los pocos en que se prohibe claramente la intervencion militar en la seguridad interna. El diseno creado en los primeros anos de la transicion a la democracia apuntaba a juridizar la relacion civico-militar, de modo de separar claramente lo correcto de lo ilegal y marcar un quiebre con la tradicion golpista. Este camino, sin embargo, estuvo marcado por avances y retrocesos, levantamientos militares y la busqueda, por parte de las Fuerzas Armadas, de nuevos espacios de autonomia. Aunque el gobierno de Nestor Kirchner ha reinstalado una agenda de derechos humanos e implementado algunas medidas importantes, la institucionalizacion del nuevo rol de los militares esta lejos de haberse consolidado. EnglishOf the Latin American countries, Argentina is the one that has made the greatest advances in civilian control of the armed forces. It was the first to submit those responsible for the dictatorship to justice and one of the few that explicitly prohibit military involvement in internal security problems. In the first years of the democratic transition, the aim was to establish a clear legal basis for the separation between civil and military competences, with a view to overcoming the legacy of the military coups. The process has not been without its problems: military rebellions and attempts on behalf of the armed forces to carve out new spheres of autonomous action. While Nestor Kirchner�s government has been committed to a human rights agenda and has introduced important measures, the institutionalization of the new role of the military has as yet not been consolidated. |
