| Abstract | Indigenous communities have a special jurisdiction under their autonomy, customs and cultural ancestors, unlike the ordinary jurisdiction, however behaviors related to drug trafficking presents a dichotomy when selecting a procedural model applicable to the case; to solve this problem the law provides a number of tools to ensure some measure of respect for ethnic diversity when determining which jurisdiction would be eligible, they can be supplemented if the principle of proportionality is used in relation to the customs and practices from indigenous tradition and culture, existing government policy both for the prosecution of drug trafficking and for the preservation of cultures. |
