| Abstract | This paper assumes the constituent power’s identity crisis as a Brazilian political context’s reality at the 21st century’s beginning. In this scenario, a reflection based on the democratic institutionality’s contours, instead of theoretical foundations on certain "constitutional rights", is proposed. As a paradigm, it is sought to analyze the constitutional change’s circumstances effected by the Superior Courts in Brazil regarding the statutory definition of party infidelity’s acts and their relationship with the causes of mandate’s loss. From the mapping of this phenomenon, it is possible to find an alternative to overcoming the confusion between constituent power and constituted power. |
