| Abstract | An Attempt at Determining Psychopathic Personality Traits in Criminally Responsible Mentally and Disordered Offenders According to § 21/2 of the Austrian Criminal Code by Means of Pupillometry. The aim of the present study was to determine whether pupillometry is able to identify psychopathic personality traits in criminally responsible mentally disordered offenders (§ 21/2 StGB). Psychopathic disorder has not only behavioral but also psychophysiological correlates, which may be evaluated by pupillometry. This might make it possible to diagnose psychopathy by means of a non-invasive method without causing too much stress to the patient and in a further step to adapt therapeutic measures accordingly, which could prove the practical relevance of this diagnostic tool. The activation of the pupillary muscle by the autonomic nervous system cannot be controlled deliberately. Thus, manipulation is highly improbable or even impossible, which is of great importance in a forensic context. As personality disorder patients show a higher pupillary activation than those with solely mental retardation or organic disorders, pupillometry might make an essential contribution to the diagnosis of psychopathy. The present investigation is the fi rst to focus on the research question described above. Results suggest that mainly the parameter of activation (pupillary diameter) might play an important role in reliably diagnosing psychopathic personality traits, as it refl ects pupillary reagibility to various stimuli. As described above, in psychopathic disorder, the cognitive reaction to different – mainly emotional – stimuli is reduced. Although results are still somewhat ambiguous and further investigations are necessary, in the future pupillometry might be a valuable tool in the diagnosis of psychopathy.
