| Abstract | RESUMEN: La necesidad de mantenerse en un plano competitivo en la lucha por captar la inversión extranjera directa y preservar al mismo tiempo la conducción de las áreas estratégicas de la economía fueron los dos elementos destacables de la estrategia de negociación del gobierno de México en el capítulo de inversión en el TLCAN. La práctica desarrollada a lo largo de diez años de experiencia, ha manifestado vínculos destacables entre medio ambiente y solución de controversias en materia de inversión extrajera, lo que hace necesaria una revisión a este momento de cuáles han sido los casos planteados y las decisiones adoptadas en la materia. ABSTRACT: The need to adhere to a competitive plan in the struggle to attract direct foreign investment and, at the same time, to preserve the direction of the strategic areas of the economy, were the two salient elements of the negotiating strategy of the Mexican Government in the investment chapter in the TLCAN. The practice developed during ten years of experience, has manifested salient connections between the environment and the resolution of controversies in the subject of foreign investment, which makes it necessary to now review what cases have been posed and the decisions made on the subject. |
