| Abstract | The research problem to be addressed is, if the Decree 98 of 2004 on informal commerce in Bogota, regarding the mechanisms of recovery of public space as a collective right against the individual right to work of street vendors is effective, it is pertinent to point out that To establish efficacy, it is necessary to carry out fieldwork in the field of empirical verification of the hypothesis. In Colombia, more specifically in Bogota, there is a conflict between the common good and the collective right, such as the enjoyment of public space and the individual right to work and to the vital minimum; In general, informal sellers who choose to engage in this type of informal work hide characteristics that can be determined as extreme poverty and a low level of education, all due to the lack of opportunities to access a formalized labor situation. The objective of this research is to analyze the effectiveness of Decree 98 of 2004 on informal commerce, by which provisions are made in relation to the preservation of public space and its harmonization with the rights of the informal sellers who occupy it; It will be studied how effective the public policies that have been made for the recovery of the public space have been, and if they have affected article 25 of the political constitution that refers to the "Right to work", which is a fundamental right, and That in this norm the general right to the private individual. |
