| Abstract | THE JURISPRUDENCE OF THE INTERAMERICAN COURT OF HUMAN RIGHTS REGARDING THE FREEDOM OF EXPRESSION VERSUS THE RIGHT TO REPUTATION AREA(S) DO DIREITO : direitos fundamentais; direito internacional publico. RESUMO : O presente estudo visa a elucidar a orientacao da Corte Interamericana de Direitos Humanos perante o julgamento de casos que versam sobre a colisao entre a liberdade de expressao e o direito a honra. Para tanto, sera feito o exame do Sistema Interamericano de Direitos Humanos, do conteudo dos direitos a honra e a liberdade de expressao, bem como do confronto entre tais direitos fundamentais, tendo por base a revisao de doutrinas nacional e internacional, da legislacao e da jurisprudencia sobre tais temas. Outrossim, serao analisados tres acordaos emblematicos que compoem a jurisprudencia da Corte versando sobre o assunto, quais sejam: Herrera Ulloa vs . Costa Rica, Ricardo Canese vs . Paraguai e Kimel vs . Argentina. Ao longo do estudo, serao discutidos os criterios utilizados pela Corte na interpretacao do direito fundamental a liberdade de expressao – garantido pelo art. 13 do Pacto de Sao Jose da Costa Rica – e de sua ponderacao com o direito fundamental a honra – previsto no art. 13.2 do mesmo documento –, tendo em vista o entendimento consolidado na Opiniao Consultiva no 5/85, no sentido de que a liberdade de expressao e direito que assume maior peso a priori em razao de sua maior dimensao social. ABSTRACT : This essay aims to elucidate the stance of the Inter-American Court of Human Rights before the trial of cases that deal with the collision between the freedom of expression and the right to reputation. This topic is hereby examined through the review of doctrine, legislation and jurisprudence regarding the Inter-American System of Human Rights, the content of the rights to reputation and freedom of expression, as well as the confrontation between both fundamental rights. In addition, three emblematic cases that make up the jurisprudence of the Court on the subject will be analyzed, namely: Herrera Ulloa vs. Costa Rica, Ricardo Canese vs. Paraguay and Kimel vs. Argentina. Throughout the study, the criteria used by the Court in interpreting the fundamental right to freedom of expression – guaranteed by article 13 of the Pact of San Jose de Costa Rica – and its opposition to the fundamental right to honor – provided for in article 13.2 of the same document – will be discussed in view of the understanding consolidated by Advisory Opinion no 5/85, in the sense that freedom of expression is a right that assumes greater importance a priori because of its greater social dimension.
