| Abstract | La presente investigacion tiene por finalidad analizar el llamado derecho de opcion del acreedor, ante el incumplimiento contractual, a la luz de la doctrina y jurisprudencia anglosajona. Particularmente, interesa establecer el o los nexos entre este y el Derecho europeo continental de las obligaciones, toda vez que, dichas instituciones y principios podrian dar luz acerca de las nuevas orientaciones que debiese tener el nuevo Derecho europeo de las obligaciones. Abstract: This research aims to analyze the so-called right of option of the creditor, before the breach of contract, in the light of the doctrine and Anglo–Saxon jurisprudence. Particularly interested in establishing or links between it and the continental European law of obligations, since, these institutions and principles could shed light on new guidance which is expected to have the new European law of obligations.
