Abstract	Considering the premise of valuing human life in the 1988 Constitution , this study addresses the principle of equality and its effects on labor social relations , and the need to curb discriminatory acts in relation to tobacco presence and obesity in contracts work. In addition , it aims to search the current legislation is smoking and obesity may be considered occupational diseases in attaining the social rights of workers discussing about the causal relationship between these factors and the working environment.
