| Abstract | Some historical data concerning the German idea of the Rechtsstaat and the Anglo-American idea of the Rule of Law are presented. It is argued that, although dressed up in rather different garb, these two concepts are in fact based on the same fundamental idea and stand for the same values—all ideas that are in the European tradition older than their British and German variants. Moreover, the development after World War II is characterised by no small degree of convergence between them. My book can be seen as a contribution to the formulation of a universal idea—the idea of the law-state—merging these two. My purpose is to construct a general framework of thought which, if successful, enables us to deal with this cluster of interrelated ideas with more perspicuity and consideration to nuances than is usually the case. I formulate the nucleus of the law-state idea thus: That the individual enjoys legal protection against violations caused by the exercise of power on the part of the state. |
