Situação Dos Postos De Combustíveis No Município De Rio Claro/sp Quanto Ao Licenciamento E Ao Passivo Ambiental

Abstract	Entre os mecanismos de controle e de gerenciamento ambiental das atividades antropicas destaca-se o licenciamento para o qual o conhecimento das caracteristicas e dos impactos decorrentes das atividades proporciona os instrumentos necessarios a tomada de decisao quanto a emissao da licenca. No Brasil, a exigencia para o licenciamento dos empreendimentos revendedores de combustivel foi feita pela Resolucao do Conselho Nacional do Meio Ambiente (CONAMA) no 273, de 29.11.2000. Com base em informacoes disponiveis no endereco eletronico da CETESB e de pesquisa documental junto aos seus arquivos, este trabalho buscou realizar a revisao situacional do licenciamento desses empreendimentos no municipio de Rio Claro/SP. O municipio possui 57 postos de combustivel, dos quais 50 instalados anteriormente a resolucao e 7 instalados apos esta. Dos antigos, 5 encerraram suas atividades e mais de 80% dos postos restantes obtiveram suas licencas. Em relacao ao total dos empreendimentos, cerca que 67% apresentaram contaminacao do solo e/ou das aguas subterrâneas. Os postos novos encontram-se licenciados em sua totalidade. A final, o trabalho analisa o cumprimento da resolucao CONAMA 273 no municipio de Rio Claro/SP. Palavras-chave:postos de combustiveis; licenciamento ambiental; legislacao ambiental. SITUATION OF GAS STATIONS IN THE MUNICIPALITY OF RIO CLARO/SP REGARDING LICENSING AND ENVIRONMENTAL LIABILITY ABSTRACT Among the control mechanisms and environmental mangement in human activities stand out the environmental license. In the licensing process, the knowledge of the project characteristics and the impacts of their developping activities provides the necessary tools to make a decision regarding the issuance of the license. In Brazil, the requirement for licensing of gas station was made by resolution of the National Council of the Environment (CONAMA) No 273 of 29.11.2000. Based on information available at the website of CETESB and documentary research among its files, this study attempts to make a situational review of licensing of the gas stations in Rio Claro city. This city has 57 gas stations, 50 of which were prior to the resolution and 7 were installed after this. Among the gas station installed befor the resolution, 5 stopped their activities berfore the licenses process and 80% obtained their environmental licenses; 67% of the totality had soil and/or groundwater contaminated. The new 7 gas stations are licensed. These statistical results show that the CONCAMA resolution fulfilled its purpose in Rio Claro city.
