| Abstract | El proceso de privatizacion de la empresa de telecomunicaciones en Nicaragua se inicio en 1995, despues de un esfuerzo importante para su modernizacion en la primera mitad de esa decada. Sin embargo, como en algunos otros paises de la region centroamericana (pero tambien latinoamericana) este proceso favorecio mucho a la empresa que adquirio esa compania. En la ley 210 de privatizacion e incorporacion de particulares en la operacion de los servicios publicos de telecomunicaciones se incluyo una clausula de exclusividad por tres anos para el monopolio privado. Asimismo, el gobierno decidio mantener la integracion vertical del monopolio, otorgando concesion exclusiva no solo en telefonia fija local, sino tambien en telefonia fija de larga distancia nacional e internacional. Ademas, mediante la citada concesion se otorgaron licencias para la operacion de los servicios de telefonia celular y publica, asi como en otros servicios de telecomunicaciones. Asi, la apertura y la privatizacion de las telecomunicaciones en Nicaragua si bien ha significado la ampliacion de la cobertura de estos servicios, incluyendo la telefonia movil, ello ha ocurrido mas debido al avance tecnologico que a un mercado competido. Se ha dado un proceso de concentracion y las tarifas de llamadas internacionales estan entre las mas altas de la region. Las practicas anticompetitivas son usuales y la regulacion del sector se ha visto debilitada por diversos conflictos. Competition and regulation of telecommunications: the case of Nicaragua Abstract: In 1995, a privatization process of the telecommunication industry was initiated in Nicaragua. However, like other countries in the region of Latin America, this process favoured the enterprise that bought the state owned company. The Nicaraguan law 210, pertaining to privatization and incorporation of public services of telecommunications, includes an exclusivity clause ensuring three years of private monopoly of this industry. In addition to this, the government decided to maintain a vertical integration of the monopoly, granting exclusive concession not only to local phone line, but also long-distance phone lines for national and international calls. Also, in addition to other services of telecommunication, the concession grants the beneficiaries licenses to operate cellular phone lines as well as public phone lines. As such, despite the fact that the privatization of telecommunications in Nicaragua has resulted in an expansion of phone services coverage, including mobile telephone services, this occurrence is consequence of technological advancements instead of market competition. The privatization has resulted in a concentration process and the international calls prices are some of the highest of the region. Anti competition practices are commonly witnessed and the regulation of the sector has been diluted by several conflicts. |
