| Abstract | The article analyzes the tension between the public power and the common workers of the city of Fortaleza during the nineteenth century. At first the workers, in the midst of the local tradition, circulated freely in the public space. In the second half of the 19th century, after an intense process of modernization and embellishment of the city, the popular were obliged to migrate to marginality, forbidden to work in the name of civility and morality, under the protection of law, since it institutionalized such limitations of circulation . The purpose of the text is to understand how the process of removal of the sellers and loaded with their customary rights to work was gradually withdrawn from their hands. It is concluded from this research that the laws passed by the political elite from Fortaleza benefited the emerging merchant class to the detriment of the working poor, away from access to citizenship and their rights. It is worth noting that the already consolidated right to freedom of movement, supported by the guarantee of freedom, did not impede the application of local legislation that limited exactly the same freedom to come and go. This inevitably provokes the discussion about the force of law in a strongly patrimonial society. |
