| Abstract | Circle is disappointed by the Competition Commission (“CC”)’s Provisional Decision on Remedies (“PDR”). There has been a significant dilution of the remedies package which, left unaltered, threatens the overall effectiveness of the remedies with which the CC plans to proceed. In respect of some of its conclusions, the CC does not appear to have relied on any evidence and Circle considers that, in failing to address the key issues, the CC has not fulfilled its statutory obligations and the private healthcare sector will remain characterised by a lack of genuine competition and high barriers to entry. This would be a dire outcome for patients who will continue to be denied meaningful choice, clinical innovation and more affordable healthcare. |
