Abstract	JUSTICA RESTAURATIVA: NOVAS LENTES E NOVO FOCO PARA O SISTEMA PENAL RESTORATIVE JUSTICE: NEW EYES AND NEW FOCUS ON THE CRIMINAL SYSTEM Jeane Gazaro Martello [1] RESUMO: O presente trabalho versa sobre a Justica Restaurativa e o novo foco que traz para o sistema penal, especialmente no Brasil, tomando como exemplo a experiencia em Porto Alegre, capital do Rio Grande do Sul. O objetivo e demonstrar a necessidade da participacao da vitima e da ressocializacao do apenado, uma vez que o atual sistema de justica, caracterizado como retributivo e punitivista, mostra-se ineficaz nesses aspectos. A Justica Restaurativa e um meio alternativo, capaz de oferecer o acesso a justica com mais igualdade entre as partes e com a efetiva compensacao do dano sofrido pela vitima, afastando a ideia de vinganca e trazendo a recomposicao da comunidade e a reinsercao do infrator. E demonstrado que, em nosso pais, faz-se necessaria a mudanca de lentes dos cidadaos, para que a dificuldade cultural de aceitacao do novo modelo seja superada, abandonando a divisao entre “cidadaos de bem” e “cidadao do mal”. Apresentam-se alguns limites enfrentados pela Justica Restaurativa em seu iniciante processo no pais. PALAVRAS-CHAVE: Justica Restaurativa; Vitima; Ressocializacao do Infrator. ABSTRACT: The present paper deals with Restorative Justice and the new focus that it brings to the criminal justice system, especially in Brazil, taking as an example the experience in Porto Alegre, capital of RS. The main goal is to demonstrate the need of participation of victims and resocialization of the convict, since the current system, characterized as retributive and punitive, has not been effective in these aspects. Restorative justice is as an alternative mean, capable of providing access to justice with more equality between the parties, with an effective compensation of the damage suffered by the victim, leaving behind the idea of revenge and bringing recovery to the community and reintegration of the offender. It shows that, in our country, it is necessary to change the lenses of citizens to overcome the cultural difficulty of acceptance of the new model, in order to leave behind the social division between "good citizen" and "bad citizen". We present some of the limitations faced by the Restorative Justice as a beginner process in the country. KEYWORDS: Restorative Justice. Victim. Resocialization of the Offender.
