| Abstract | The devastating worldwide consequences of tobacco consumption and exposure to tobacco smoke led the World Health Organization to the adoption on the 21st May 2003 of the Framework Convention on Tobacco Control. Implementation of the Convention has provoked serious debates on the compatibility between the new international tobacco control regime and the free trade rules enforced by the World Trade Organization. The study of the Law of the WTO and the jurisprudence of its dispute settlement bodies suggests that the multilateral trading system gives States generous room to manoeuvre when adopting tobacco control measures. Consequently, the design of measures which develop FCTC provisions needs to be carefully done to ensure coherence with the multilateral trading system. Otherwise, the development by governments of tobacco control measures in application of the Convention will not be free from problems and may in fact cause conflicts with WTO agreements. |
