| Abstract | The retirement allowance is an economic benefit enjoyed by all members of the Public Force and especially the executive level of the National Police, for providing a service to the community. Because their activity represents an imminent risk to life and their family environment, other than the work normally performed by a common worker. That is why they acquire this special benefit right that is very similar to an old-age pension that is granted to other workers in Colombia governed by Laws 100 of 1993 and 797 of 2003, therefore, the uniformed personnel of the National Police who are Directly incorporated to the executive level, suffered a detriment to their right to equality with the issuance of the statutory decrees 4433 of 2004 and 1858 of 2012, issued by the National Government after 2004, since there they were unknown to the other members of the police institution, the minimum time to voluntarily access a retirement allowance, which could not exceed 20 years of service, as evidenced by the different judgments delivered by the Council of State, when declaring the nullity of these legal provisions. |
