A prevenção criminal em uma nova perspectiva: ações afirmativas como medida de redução da vulnerabilidade de egressos do sistema carcerário brasileiro

Abstract	The present study, developed in the modality of dissertation for master’s degree, has as object the study of crime prevention , not from the perspective of the purpose of punishment, but by designing the vulnerability of criminals, especially the egress of the prison system, based on the theory proposed by Zaffaroni, complemented by the criminal legal conception of prevention Roxin. In this context, the work now developed to be treated more specifically the need to promote public policies and affirmative action for the social inclusion of the graduates from the perspective of human dignity. Looking, first, to demonstrate prevention as conceived within the criminal matter depending on the legitimizing discourses, covering up the theories of punishment, to the delegitimization of the system based on studies of critical criminology. Asserts itself the condition of vulnerable criminal, and in particular of egress, emphasizing the multifactorial nature of deviant behavior and social discrimination. Therefore, based on statistical data, we draw a profile of graduates, and paying attention to the selectivity recognition of penal control agencies, it becomes clear violations of fundamental rights. Also described them extrapenais public policies and programs of socialization, attending to the indispensability of coordinated actions between the various sectors of society. Finally, we propose the need to implement affirmative action as a mechanism of effectiveness of the principle of equality and non-discrimination conditions as alternatives to reduce the vulnerability of egress, and therefore crime.
