| Abstract | The evolution of the international situation after the 11th September has determined profound changes. New categories of reference and new lines of development have emerged in the outline of International and Community law in connection to the terroristic phenomenom. Systematic changes are being made in the discipline of international law, moreover it seems decisive to analyse the conformed regulations, starting from the European Conference for the repression of terrorism in 1977, to the Framework Decision of 13th June 2002, the present day acts and communitarian trends arriving at the clearly defined Constitutional Treaty for Europe. The Petersberg missions and the use of military contingents in anti-terrorism roles can be mainly interpretated in the light of the development and the construction of the new relationship between NATO and the UE established in Prague Summit in 2002 and in Istanbul Summit in 2004. The enlargement of NATO in East Europe and the entry of Eastern European countries in NATO can be translated as a growth of means and competency for intelligence. The umbrella offered by NATO during the Olympic games in 2004 represents an emblematic hypothesis. There are four fundamental points to perfect in the fight against terrorism: intelligence, diplomatic action, judicial activity and military support. L’evolution de la situation internationale apres le 11 septembre 2001 a determine de gros changements. On a vu praitre de differentes categories de reference ainsi que de nouvelles lignes de developpement du cadre de droit international et communautaire concernant le phenomene terroriste. Il y a, en effet, en cours de realisation des changements dans les elements de nature systematique de la reglementation du droit international. Il vaut bien, en outre, analyser les regles representees a partir de la Conference Europeenne pour la repression du terrorisme de 1977, a la Decision-cadre du 13 juin 2002, aux actes actuels et aux adresses communautaires et jusque’aux perspectives definies par le Traite Constitutionnel pour l’Europe. Le mission de Petersberg ainsi que l’emploi de recrutement des forces armees en fonction de contre-terrorisme sont les plus interpretables au vu et au su du developpement du rapport UE-OTAN des Sommets de Prague 2002 et de Istanbul 2004. L’epanouissement de la OTAN a l’Est Europeen ainsi que l’entree des pays de l’Est dans l’Union, se traduisent dans une expansion du patrimoine des capacites d’intelligence. La protection de la OTAN pour les Jeux Olympiques d’Athenes 2004 represente une hypothese emblematique. Il y a donc un quadrimone a perfectionner dans la lotte contre le terrorisme: l’intelligence, l’activite judiciaire, l’action diplomatique et le support militaire. |
