| Abstract | With the Civil Procedure Code of 2015, a great discussion started about the public agency that has jurisdiction to hear the IRDR for lawsuits therein Small Claims Courts. In light of the aforesaid, the aim is to define who has jurisdiction over these cases: The Court of Appeals or the Small Claims second instance judges. For this purpose, by way of the deductive method, follows the analyses of the legislation, literature, and jurisprudence. To conclude that the incident will always be tried be the Court of Appeals, even in the cases in which the Small Claims Court has exclusive jurisdiction.
