Abstract	espanolEl autor analiza en el Titulo Preliminar del reciente Codigo Civil y Comercial argentino el capitulo denominado “del ejercicio de los derechos” donde se dan las mayores novedades comparandolo con el Codigo Civil de Velez Sarsfield, tales como la pluralidad de fuentes y la aparicion de dos principios, el abuso del derecho y el de buena fe. Tambien entiende que si consideramos que tal Titulo Preliminar comporta un verdadero nucleo de significaciones, nos encontramos con el problema de su interpretacion, que –conforme a la tendencia del neoconstitucionalismo adoptada– no admite univocidad. EnglishThe author analyzes in the Preliminary Title of the recent Argentine Civil and Commercial Code chapter called “exercise of Rights” where there are the biggest news in comparison with the Civil Code of Velez Sarsfield, such as the plurality of sources and the appearance of two principles, abuse of law and good faith. Also it believes that if we consider that such Preliminary Title implies a real core of meaning, we find the problem of interpretation, which –according to the tendency of adopted-neoconstitutionalism not support a unique interpretation.
